Κύριε Γενικέ Γραμματέα , αγαπητέ Συνάδελφε ,
Τα μέλη της Ελληνικής Αντιπροσωπείας, που συμμετείχαν στη Σύνοδο του Άμστερνταμ , τον Μάϊο του 2012 , ενημέρωσαν την Ευρωπαϊκή Ένωση Δικαστών, ότι, σε εφαρμογή των μέτρων λιτότητας , που έχουν επιβληθεί από την ελληνική κυβέρνηση , οι αποδοχές των ελλήνων Δικαστών έχουν μειωθεί σε ποσοστό 38% ποσοστό υψηλότερο από τις μειώσεις σε όλο το Δημόσιο Τομέα , που κυμαίνονται από 15-25% , με αποτέλεσμα οι καθαρές ( μετά τις κρατήσεις φόρων κ.λ.π. ) μηνιαίες αποδοχές του Προέδρου του Ανωτάτου Δικαστηρίου να είναι 5.000 € των μελών του Ανωτάτου Δικαστηρίου ( Αρεοπαγιτών) 4.500 € και των Δικαστών του πρώτου βαθμού από 2.300 έως 3.000 €. Τα ποσά αυτά είναι ίσως υψηλότερα από ορισμένων άλλων Κρατών της Ευρωπαϊκής Ένωσης, πλην όμως, και το κόστος ζωής στην Ελλάδα είναι από τα υψηλότερα στην Ευρωζώνη . Σημειωτέον ότι οι αποδοχές των Ελλήνων Δικαστών διασφαλίζονται από το Σύνταγμα , το οποίο στο άρθρο 88 ορίζει ότι « οι αποδοχές των Δικαστικών Λειτουργών είναι ανάλογες με το Λειτούργημά τους». Εν τούτοις , παρά την συνταγματική προστασία των αποδοχών μας και παρά τις ανωτέρω μεγάλες μειώσεις , η Τρόϊκα επιμένει και ζητά από την νέα Ελληνική Κυβέρνηση να εφαρμόσει το Μνημόνιο II , που είχε υπογράψει η προηγούμενη Κυβέρνηση και να επιβάλλει και άλλες, επί πλέον μειώσεις και στις αποδοχές των Δικαστών. Η Κυβέρνηση έχει προτείνει, αντί των μειώσεων, άλλα ισοδύναμα μέτρα και αναμένει την απάντηση της Τρόικας μέχρι την 23-7-2012.
Οι νέες αυτές μειώσεις είναι αντίθετες προς τα Διεθνή standards, αντίθετες προς την απόφαση της Διεθνούς Ένωσης Δικαστών, της συνόδου της Κωνσταντινούπολης και επίσης , είναι αντίθετες προς το ελληνικό Σύνταγμα , αφού οι αποδοχές μας δεν θα είναι πλέον ανάλογες με το Λειτούργημά μας, και επίσης δεν θα εξασφαλίζουν την αξιοπρεπή διαβίωση των Δικαστών, ώστε να τίθεται σε κίνδυνο η προστασία της ανεξαρτησίας της Δικαιοσύνης. Για τους λόγους αυτούς, σας παρακαλούμε να μας στηρίξετε στο αίτημά μας, ώστε να μην υπάρξει οποιαδήποτε άλλη περικοπή στις αποδοχές μας και αφού διαβιβασθεί το παρόν έγγραφο και στον Πρόεδρο της Ευρωπαϊκής Ένωσης Δικαστών, να εκδοθεί ψήφισμα και να αποσταλεί από μέρους σας το ταχύτερο δυνατό σχετικό έγγραφο τόσο προς την Ελληνική Κυβέρνηση, όσο και προς τα αρμόδια όργανα της Ευρωπαϊκής Ένωσης.

2. Επισυνάπτουμε στην παρούσα μας και σχετικά νομοθετικά κείμενα, από τα οποία προκύπτουν οι μειώσεις των αποδοχών μας, σε σχέση με τους δημοσίους υπαλλήλους.

Mr. Secretary General, dear Colleague,
The members of the Hellenic Delegation, who attended the meeting of Amsterdam, in May 2012, informed the European Association that in application of frugality measures, which are enforced from the Hellenic Government, the incomes of the Greek Judges are deducted per a percentage of 38%, a percentage which is higher than the reductions imposed at the whole Public Sector, which are fluctuating between 15 – 25%. The result is that the clear (after the deduction of taxes etc) monthly incomes of the President of the High Court equal 5.000 euros, of the Members of the High Court 4.500 euros and of the Judges of the first instance from 2.300 euros to 3.000 euros. Those sums maybe are higher than of those of the colleagues of some other Member States of the European Union, but the cost of living in Greece is of the highest in the Eurozone. It is noticed that the incomes of the Greek Judges are ensured from the Constitution, which in the art. 88 stipulates that “the incomes of the Judicial Officers are commensurate to their vocation.” Despite of this constitutional protection of our incomes and despite the above great deductions, Troika insists and requires from the Hellenic Government to implement the Memorandum II, which is undersigned from the previous government and to impose accessional deductions to the incomes of the Judges. The Greek Government has suggested, instead of deductions, other measures to be taken and an answer from the part of Troika is expected till 23 July 2012.
Those new deductions are violating the International Standards and are opposing the resolution of the International Association of Judges of Istanbul and, also, are contradictious to the Hellenic Constitution, as our incomes are no more commensurate to our vocation and do not ensure any more the decent way of living of the Judges, so that the independence of the Judiciary is put in danger. For those reasons, we are asking from you to support our request, for no further more deductions of our incomes. So after submitting this letter to the President of the European Association of Judges, we ask for a resolution to be send from your part, as soon as possible, to the Hellenic Government and to the competent organs of the European Union.

Monsieur le Secrétaire General, cher Collègue,
Les membres de la délégation hellénique, qui ont participer a la Réunion d’ Amsterdam, ont informé l’ Association Européenne que, en application des mesures de frugalité, qui sont imposés par le Gouvernement Hellénique, les appointements des Magistrats Grecs ont diminué d’ un pourcentage de 38%, pourcentage supérieur des déductions de tout le Secteur Public, qui fluctuent de 15-25%. Par conséquent les appointements nets (après les déductions d’ impôts etc) du salaire mensuel du Président de la Cour de Cassation est egal a 5.000 euros, des Membres de la Cour de Cassation a 4.500 euros et des Magistrats de la Première Instance de 2.300 a 3.000 euros. Cettes sommes sont peut être supérieures a celles de nos collègues d’ autres États Membres de l’ Union Européenne, mais le cout de vie en Grèce est un des plus élevés dans l’ Eurozone. C’ est remarquable que les appointements des Magistrats Grecs sont protégés par la Constitution, qui a l’ article 88 statue que les «appointements des Magistrats sont analogues a leur office ». Cependant, malgré la protection constitutionnelle de nos salaires et rien moins que les grandes déductions ci-dessus, la Troïka insiste et exige par le Gouvernement Grec d’ exécuter le Mémorandum II, qui est signé par le gouvernement précédent et d’ imposer des déductions supplémentaires aussi bien aux salaires des Magistrats. Le Gouvernement Hellénique a proposé, au lieu de déductions, d’ autres mesures équivalentes, et la réponse de Troïka est attendu jusque le 23 Juillet 2012.
Ces nouvelles déductions sont contraires aux standards internationaux et s’ opposent a la résolution de Constantinople de l’ Union Internationale des Magistrats et aussi, elles s’ opposent a la Constitution Grecque, puisque nos appointements ne seront plus proportionnelles a notre office, et aussi n’ assureront plus une vie digne des Magistrats, si bien que l’ indépendance de la magistrature se trouvera en danger. Pour ces raisons nous vous prions de soutenir notre demande, pour éviter toute nouvelle déduction de nos salaires et, après avoir soumis cette lettre au Président de l’ Association Européenne des Magistrats, nous demandons de votre part une résolution qui sera renvoyée de votre part, le plus vite possible, au Gouvernement Grec et également aux organes compétents de l’ Union Européenne.
